San Diego Solicitation Defense Attorney
What is the crime of solicitation?
Under the state penal code having to do with prostitution, solicitation is defined as offering or agreeing to engage in a sexual act. Prostitution is engaging is any lewd act or sexual intercourse with another person in exchange for money. Both of these acts are illegal. For a judge to convict you of soliciting prostitution, it must be proved that you solicited someone for the purpose of engaging in prostitution, and that you had the particular intent of partaking in prostitution. Either the prostitute or the customer may be charged with solicitation. This is dependent upon what was said, and who initiated the conversation.
Just attempting to induce or lure a person is not enough to be convicted of solicitation. Behavior such as waving to a passing car, standing on a corner in suggestive clothing, nodding one's head to someone you do not know, or being in a venue where prostitution occurs is not enough to prove solicitation has occurred. It must be proven that there was the distinct intention to participate in prostitution.
