Expungement is a civil procedure that allows individuals with a state or federal criminal record to have their case dismissed. It is done by petition to the court. There are many benefits to the petition being approved, particularly in the area of employment. You must also have paid any required fines or restitution, completed counseling, or other programs ordered by the court at the time of your sentencing.

Expungement Attorney in San Diego

The state has two primary types of expungement, a Petition for Dismissal, and a Certificate of Rehabilitation (CR). When a Petition for Dismissal is approved, there will still be a record; however the guilty verdict becomes a dismissal. A CR applies to individuals who typically have served time in a state prison, usually for a felony conviction. It requires the submission of an application to the Superior Court. If accepted, a note is added to the person's record stating that they are now "rehabilitated." Criminal records resulting from juvenile crimes can be sealed.

  • The person has lived in the state for 5 years
  • The person was convicted of a felony, (or a misdemeanor sex crime)
  • The conviction occurred in California
  • The person was imprisoned for the crime in this state
  • The person has not been convicted and jailed for other crimes since being released
