The state has two primary types of expungement, a Petition for Dismissal, and a Certificate of Rehabilitation (CR). When a Petition for Dismissal is approved, there will still be a record; however the guilty verdict becomes a dismissal. A CR applies to individuals who typically have served time in a state prison, usually for a felony conviction. It requires the submission of an application to the Superior Court. If accepted, a note is added to the person's record stating that they are now "rehabilitated." Criminal records resulting from juvenile crimes can be sealed.

- The person has lived in the state for 5 years
- The person was convicted of a felony, (or a misdemeanor sex crime)
- The conviction occurred in California
- The person was imprisoned for the crime in this state
- The person has not been convicted and jailed for other crimes since being released
