Every DUI case is unique, but there are several steps that occur in every case, including:
- A stop - Every DUI case begins with a stop by law enforcement, usually because the driver has driven erratically, or has committed another infraction, such as possession of expired registration tags. Once the police officer makes contact with the driver, the investigation begins.
- Investigation - This typically begins with one being asked for their license and registration. The police officer will look for signs of intoxication, and may have the person submit to a battery of tests in order to confirm the officer's suspicions, including a breathalyzer.
- Arrest - If the officer believes he has probable cause, he will arrest the person suspected of DUI. The person will be taken to the police station for booking, which involves fingerprinting, the taking of mug shots, and being placed in a holding cell. They will be able to leave following the posting of bail or the promise to appear in court.
- Arraignment and trial - An arraignment or a DMV hearing is one's first court appearance, where they plea either guilty, not guilty, or no contest. A person or their attorney may then negotiate a plea deal with the prosecution, and if it is accepted, the judge will levy a sentence. If an agreement is not made, or the person decides to go to trial, they will have their case decided by a jury of their peers.
